Consider the following statements regarding a No-Confidence Motion in India:
- 1.There is no mention of a No-Confidence Motion in the Constitution of India.
- 2.A Motion of No-Confidence can be introduced in the Lok Sabha only.
Which of the statements given above is/are correct?
Answer & explanation
Answer: (c) Both 1 and 2
Both statements are correct, so the answer is (c). The Constitution never uses the term 'no-confidence motion'. It only says in Article 75(3) that the Council of Ministers is collectively responsible to the House of the People. The motion itself comes from the Lok Sabha's Rules of Procedure (Rule 198). Since the Council answers only to the Lok Sabha, the motion can be moved only there.
- ✓ 1. The Constitution contains no reference to a 'no-confidence motion'. The nearest provision is Article 75(3) on collective responsibility. The procedure for the motion is laid down in Rule 198 of the Lok Sabha Rules, not in the Constitution.
- ✓ 2. Under Article 75(3), the Council of Ministers is responsible to the House of the People (Lok Sabha), not the Rajya Sabha. Rule 198 of the Lok Sabha Rules governs a motion of no-confidence in the Council of Ministers. The Rajya Sabha has no such motion.
Remember · No-confidence motion: not named in the Constitution; rests on Article 75(3) and Rule 198 of the Lok Sabha Rules; moved only in the Lok Sabha, against the Council of Ministers as a whole.
