Prelims 2014 · Q62

Parliament & the Union executive Easy

Consider the following statements:

  1. 1.The President shall make rules for the more convenient transaction of the business of the Government of India, and for the allocation among Ministers of the said business.
  2. 2.All executive actions of the Government of India shall be expressed to be taken in the name of the Prime Minister.

Which of the statements given above is/are correct?

Answer & explanation

Answer: (a) 1 only

Only statement 1 is correct, so the answer is (a). Both statements come from Article 77 of the Constitution. Statement 1 is Article 77(3) word for word. Statement 2 is wrong because Article 77(1) says executive action is taken in the name of the President, not the Prime Minister.

  • ✓ 1. Article 77(3) says the President shall make rules for the more convenient transaction of the business of the Government of India and for the allocation of that business among Ministers. Two sets of rules were made under this power: the 1961 Transaction of Business Rules and the 1961 Allocation of Business Rules, both of the Government of India.
  • ✗ 2. Article 77(1) says all executive action of the Government of India shall be expressed to be taken in the name of the President. It is never taken in the name of the Prime Minister.

Remember · Article 77 has three parts. Executive action is taken in the President's name (77(1)). Orders are authenticated as specified in rules made by the President (77(2)). The President makes the rules for transaction and allocation of business (77(3)).
