India's more than 700 Scheduled Tribes range from the hunter-gatherers of the Andamans to the settled cultivators of the Northeast, yet the Constitution notifies all of them under Article 342 as one category.

Contexts for a single category

  • Constitutional identity and affirmative action: Article 366(25) defines Scheduled Tribes by Presidential notification under Article 342; reservations in education and jobs (Articles 15(4), 16(4)) and in Parliament and assemblies (Articles 330, 332) treat them as one class.
  • Protective governance: the Fifth and Sixth Schedules, PESA 1996 and the Forest Rights Act 2006 secure self-rule, land and forest rights on a common footing.
  • Shared historical disadvantage: land alienation, displacement by dams and mines, forest dependence and lagging literacy and health justify common instruments such as the National Commission for Scheduled Tribes and the Tribal Sub-Plan (now the Development Action Plan for Scheduled Tribes).
  • Political voice: one category gives bargaining weight in demands for autonomy, protection of customary law and resistance to assimilation, as in Jharkhand, Chhattisgarh and the Northeast.

Where diversity must prevail

  • Particularly Vulnerable Tribal Groups, plains tribes and hill tribes differ in language, ecology, livelihood and exposure to markets, so schemes, curricula, health outreach and livelihood plans must be tailored to each.

Tribes should be one category for rights, protection and representation, and many for the way those rights are delivered in each community's ecology and culture.
