EasyAccording to the Constitution of India, which of the following are fundamental for the governance of the country?
Answer & explanation
Answer: (c) Directive Principles of State Policy
Article 37 in Part IV of the Constitution says the Directive Principles of State Policy are "fundamental in the governance of the country". It also makes it the State's duty to apply them when making laws. No provision gives this description to Fundamental Rights or Fundamental Duties.
- ✓ (c) Article 37 says the provisions of Part IV cannot be enforced by any court. It still calls the principles laid down there fundamental in the governance of the country, and makes it the State's duty to apply them in making laws.
- ✗ (a) Fundamental Rights (Part III) are enforceable by courts and limit State action. The Constitution does not describe them as 'fundamental in the governance of the country'; that phrase belongs to Article 37.
- ✗ (b) Fundamental Duties are in Article 51A (Part IVA). Article 51A lists citizens' duties and does not call them fundamental in the governance of the country.
- ✗ (d) Neither Fundamental Rights nor Fundamental Duties carries this label, so the combination fails.
Remember · Article 37: DPSPs are not enforceable by courts, yet are fundamental in the governance of the country, and the State must apply them in making laws.
