EasyWho/Which of the following is the custodian of the Constitution of India?
Answer & explanation
Answer: (d) The Supreme Court of India
The Supreme Court is the final interpreter of the Constitution. It can strike down laws and executive actions that violate it, and it enforces Fundamental Rights. For these reasons the judiciary, headed by the Supreme Court, is called the guardian or custodian of the Constitution.
- ✓ (d) The Supreme Court is the highest court and the final interpreter of the Constitution. Through judicial review it checks whether laws and government actions are valid. This is why the judiciary is described as the guardian of the Constitution.
- ✗ (a) The President is the constitutional head of the Union executive. The power to interpret the Constitution and to invalidate laws that violate it rests with the courts, not with the President.
- ✗ (b) The Prime Minister heads the Council of Ministers and is part of the executive. The executive is itself checked by the judiciary, so it cannot be the guardian of the Constitution.
- ✗ (c) The Lok Sabha Secretariat is only the administrative staff that supports the Lok Sabha. It has no role in interpreting or protecting the Constitution.
Remember · Supreme Court = guardian and final interpreter of the Constitution, and protector of Fundamental Rights (Article 32). Judicial review is the tool it uses.
