Consider the following statements:

Attorney General of India can-

  1. 1.take part in the proceedings of the Lok Sabha
  2. 2.be a member of a committee of the Lok Sabha
  3. 3.speak in the Lok Sabha
  4. 4.vote in the Lok Sabha

Which of the statements given above is/are correct?

Answer & explanation

Answer: (c) 1, 2 and 3

The correct answer is (c), statements 1, 2 and 3. Article 88 gives the Attorney-General the right to speak in, and take part in the proceedings of, either House of Parliament. The same right extends to any joint sitting and to any parliamentary committee of which he is named a member. The Article expressly denies him a vote.

  • ✓ 1. Article 88 lets the Attorney-General take part in the proceedings of either House, and that includes the Lok Sabha.
  • ✓ 2. Article 88 covers 'any committee of Parliament of which he may be named a member'. He can therefore be named to a Lok Sabha committee and take part in its work.
  • ✓ 3. Article 88 gives him the right to speak in either House.
  • ✗ 4. Article 88 says he is not entitled to vote 'by virtue of this article'. He is not a member of either House, so he has no vote in the Lok Sabha.

Remember · Article 88: the Attorney-General, like a Minister, can speak and take part in the proceedings of either House, joint sittings, and committees he is named to, but cannot vote.
