EasyWith reference to the Delimitation Commission, consider the following statements:
- 1.The orders of the Delimitation Commission cannot be challenged in a Court of Law.
- 2.When the orders of the Delimitation Commission are laid before the Lok Sabha or State Legislative Assembly, they cannot effect any modifications in the orders.
Which of the statements given above is/are correct?
Answer & explanation
Answer: (c) Both 1 and 2
Both statements are correct. Once a Delimitation Commission order is published in the Gazette of India, it has the force of law and cannot be questioned in any court. Copies are laid before the Lok Sabha and the State Legislative Assemblies concerned, but they cannot modify the orders.
- ✓ 1. Section 10(2) of the Delimitation Act, 2002 provides that on publication in the Gazette of India, every order of the Commission has the force of law and cannot be called in question in any court. Its orders therefore cannot be challenged in a court of law.
- ✓ 2. Copies of the Commission's orders are laid before the House of the People (Lok Sabha) and the State Legislative Assembly concerned. No modification in them is permissible by these legislatures.
Remember · Delimitation Commission orders have the force of law. No court can question them, and the Lok Sabha and State Assemblies before which they are laid cannot amend them.
